ORDERS:
ORDER OF DISMISSAL
This contested case is currently pending before the South Carolina Administrative Law Judge Division and is
scheduled for a hearing on the merits for July 25, 2001. The Respondent filed a Motion to Dismiss on July
11, 2001. The Petitioner filed a Response on July 16, 2001. Argument on the Motion was heard prior to the
hearing on the merits.
Rule 11 of the Rules of Procedure for the Administrative Law Judge Division provide that the request for a
contested case hearing must be made with the agency within thirty (30) days after receipt of the agency
decision. In this matter, the Respondent's Final Decision was received by the Petitioner on January 20, 2000.
The Petitioner did not file a Petition for Administrative Review until February 9, 2001. The Petitioner has
not complied with ALJD Rule 11. Therefore, it is hereby
ORDERED that the Respondent's Motion to Dismiss is GRANTED.
IT IS FURTHER ORDERED that this contested case is DISMISSED WITH PREJUDICE.
AND IT IS SO ORDERED.
