ORDERS:
ORDER TO REMAND
This matter comes before me on a Motion to Remand by the Respondent South Carolina Department of
Health and Environmental Control. The case involves an air quality construction permit issued to Port Royal
Metals, Inc. A remand to the department is being sought for the agency to consider factual issues of which it
was unaware when it issued the permit. The department became aware of the issues at a motion hearing in
this matter. S.C. Code Ann. §1-23-380 (6)(Supp.2000) allows for the remand of cases to the agency.
IT IS THEREFORE ORDERED that this matter be remanded to the Department in its entirety.
AND IT IS SO ORDERED.
