CONSENT ORDER OF DISMISSAL

This contested case comes before the undersigned by way of an agency transmittal from the South Carolina Department of Health and
Environmental Control ("Department") directing the conduct of a hearing due to the appeal by Petitioner Walter Stanley, and Walter
Stanley d/b/a Stanley's Amoco, of the issuance of Administrative Order 00-0120-UST. Prior to a hearing being held, the parties have
reached an agreement which will resolve this matter without the need for a hearing. Specifically, the parties agree that:
(1) Petitioner has complied with the terms of Administrative Order 00-0120-UST and will maintain compliance with DHEC
Underground Storage Tank Control Regulations at Bureau of Underground Storage Tank ("Bureau") Facility I.D. #11334.
(2) Petitioner will submit a completed Certificate of Financial Responsibility and proof of mechanism for Bureau Facility I.D. #11334
within 30 days.
(3) Petitioner will pay a $500.00 penalty to the Department within thirty (30) days.
Accordingly, by and with the consent of the parties, it is ordered and agreed that this contested case is dismissed.
