CONSENT ORDER OF DISMISSAL



DOCKET NO. 00-ALJ-07-0399-CC



This contested case comes before the undersigned by way of an agency transmittal from the South Carolina Department of Health and Environmental Control ("Department") directing the conduct of a hearing due to the appeal by Petitioner Walter Stanley, and Walter Stanley d/b/a Stanley's Amoco, of the issuance of Administrative Order 00-0120-UST. Prior to a hearing being held, the parties have reached an agreement which will resolve this matter without the need for a hearing. Specifically, the parties agree that:

(1) Petitioner has complied with the terms of Administrative Order 00-0120-UST and will maintain compliance with DHEC Underground Storage Tank Control Regulations at Bureau of Underground Storage Tank ("Bureau") Facility I.D. #11334.

(2) Petitioner will submit a completed Certificate of Financial Responsibility and proof of mechanism for Bureau Facility I.D. #11334 within 30 days.

(3) Petitioner will pay a $500.00 penalty to the Department within thirty (30) days.

Accordingly, by and with the consent of the parties, it is ordered and agreed that this contested case is dismissed.
