ORDERS:
CONSENT ORDER
This matter is before me by agreement of the parties for entry of a Consent Order. This contested case arises
out of a temporary pump and haul permit, which was issued by the South Carolina Department of Health and
Environmental Control (DHEC) to Summerville Business Center. DHEC issued an Administrative Order,
#00-134-W, in June of 2000, ordering that the Petitioner pay a civil penalty and comply with the provisions
of the Order. The Petitioner timely requested a contested case hearing before the Division, which was heard
by me on February 12, 2001.
The parties represent that Mr. Fields has complied with all terms of Administrative Order #00-134-W, with
the exception of payment of the fine, the amount of which was in dispute. Respondent DHEC agrees to
vacate the Administrative Order and reduce the amount of the fine, and Petitioner Fields agrees to the
following payment schedule:
a. $4,000.00 to be paid on or before May 1, 2001;
b. $4,000.00 to be paid on or before August 1, 2001;
c. $4,000.00 to be paid on or before November 1, 2001;
d. $4,000.00 to be paid on or before February 1, 2002.
THEREFORE, it is hereby ORDERED that Administrative Order #00-134-W is vacated.
IT IS ALSO ORDERED that Mr. Fields is required to pay the amount of $16,000.00 to be paid over four
quarterly installments, and that this appeal be dismissed with prejudice.
