ORDER OF DISMISSAL

This matter came before me on the request of the South Carolina Law Enforcement Division (SLED) for a public hearing on Proproped Regulation of Breath Site Videotaping/Breath Alcohol Testing. SLED published the drafting notice of regulations in the The State Register on February 26, 1999.

By Order dated March 11, 1999, a public hearing on the proposed regulation was scheduled for April 26, 1999, at the Administrative Law Judge Division. SLED advises that no oral or written comments or requests were received, and SLED, therefore, requests that the hearing scheduled for April 26, 1999, be cancelled. No hearing is required unless requested by 25 persons, a governmental subdivision or agency, or an association having not less than 25 members. S.C. Code Ann. § 1-23-110 (Supp. 1998).

For the foregoing reason, IT IS ORDERED that the above captioned case be and hereby is dismissed and the hearing scheduled for 10:00 a.m. on Monday, April 26, 1999, is cancelled.

AND IT IS SO ORDERED.
