ORDER OF DISMISSAL

This matter came before me on the request of the South Carolina Department of Labor, Licensing & Regulation - Board of Long Term Health Care Administrators, for a public hearing on proposed regulations, § 40-35-90. The South Carolina Department of Labor, Licensing & Regulation - Board of Long Term Health Care Administrators published the drafting notice of regulations in the South Carolina State Register, on October 24, 1997.

By Order dated October 13, 1997, a public hearing on the proposed regulations was scheduled for December 9, 1997, at the Administrative Law Judge Division. The South Carolina Department of Labor, Licensing & Regulation - Board of Long Term Health Care Administrators, advises that no oral or written comments or requests were received and the South Carolina Department of Labor, Licensing & Regulation - Board of Long Term Health Care Administrators, therefore requests that the hearing scheduled for December 9, 1997, be cancelled. No hearing is required unless requested by 25 persons, a governmental subdivision or agency, or an association having not less than 25 members. S. C. Code Ann. § 1-23-110 (Supp. 1996).

For the foregoing reason, it is ORDERED that the above captioned case be and hereby is dismissed and the hearing scheduled for 1:00 p.m. on Tuesday, December 9, 1997, is cancelled.

AND IT IS SO ORDERED.
