CONSENT ORDER

The parties, through counsel, advise that they have agreed that the Order of Temporary Injunction, dated March 8, 1994, should be extended and the relief requested by the Plaintiff Board should be granted, until such time as the pending proceedings under the S.C. Medical Practice Act may be conducted and a final agency decision is issued concerning the merits of this matter.

The parties further advise that their agreement is based in part upon their mutual understanding that the physician may perform acts which are not defined as "the practice of medicine" under S.C. Code Ann., §40-47-40 (Supp. 1993). It is expected that the physician will continue to render reports, offer opinions, have such conferences with counsel as might be appropriate in anticipation for testimony, and offer sworn testimony in judicial proceedings regarding his expert opinions or medical care rendered prior to the effective time of the Order of the Temporary Injunction. It is further anticipated that the physician will continue to process account receivables both for medical services rendered prior to the effective time of the Order of Temporary Injunction as well as for the time expended in rendering reports and preparing for and giving expert testimony.

THEREFORE, WITH THE CONSENT OF THE PARTIES, IT IS SO ORDERED.
