ORDERS:
ORDER OF DISMISSAL
This case is before the court for a contested case hearing based on the
Respondent’s denial of the Petitioner’s application for a Pawnbroker
Certificate of Authority. The Petitioner notified this Court by letter dated
October 11, 2006, but not received by the court until October 24, 2006, that
she desired to withdraw her request for a contested case hearing. Apparently,
counsel for the Petitioner sent the notice to an incorrect address for the
court, thereby delaying the receipt of this notice. The court was unaware that
the parties would not appear for the hearing set for October 24, 2006. At the
call of the case, the parties were not present. The court contacted the
attorney for the Respondent who indicated that counsel for the Petitioner had
withdrawn the request for a contested case hearing several weeks previously. There
being no case in controversy after the Petitioner’s withdrawal,
IT IS THEREFORE ORDERED that this case is DISMISSED. The
hearing set for Tuesday, October 24, 2006 at 10:00 AM is cancelled. However,
the parties shall be assessed the cost of the court reporter due to the failure
of the parties to notify the court of the withdrawal of request for the
contested case hearing in a timely manner or to confirm that the hearing had
been cancelled. Once an invoice is received from the court reporting service,
it will be forwarded to both counsel of record with the instruction to each pay
one half of the invoice amount within thirty days of the date of mailing.
