CONSENT ORDER

Before hearing of this matter on December 2, 1999, the parties entered into an agreement concerning the issues to be presented to the Administrative Law Judge Division. By this agreement, the Petitioner agrees to reduce the penalty assessed against the Respondent to Two Hundred Fifty ($250.00) Dollars. The Respondent agrees to withdraw its contest to Citation No. 797-99, the subject of this action, thereby otherwise accepting the citation as a final order of the Department of Labor.

I have reviewed the terms of this agreement and find it is consistent with the purposes of the South Carolina Payment of Wages Act and in the best interest of the public.

IT IS THEREFORE ORDERED that the agreement between the parties be approved and that this contest be DISMISSED.

AND IT IS SO ORDERED.
