ORDERS:
FINAL ORDER
The matter in dispute is a sales tax controversy in which the South Carolina Department of
Revenue (Department) assessed liabilities against the Petitioner. The parties have entered into
settlement negotiations and have resolved their differences. The Petitioner agrees to collect sales
tax on factory to customer freight charges and factory to petitioner freight charges from December
1995 forward. The Petitioner further agrees that such freight charges will be included in gross
proceeds of sales on its monthly sales tax return without deduction for such charges, and that the
sales tax collected will be properly remitted to the Department. Pursuant to the terms indicated
above the parties wish to end this litigation.
Based on the consent of the parties, as evidenced by the signatures of the parties below, it is
the order of this Court that this matter is forever ended and dismissed with prejudice to all parties
to this suit, as well as those parties in privity to such parties.
