ORDERS:
ORDER OF DISMISSAL
The Administrative Law Judge Division (ALJD) received a request for a contested case in this action from the Petitioner
seeking review of the assessed value of her motor vehicle by the Georgetown County Auditor. The Petitioner now lives in
Michigan and has since the filing of this case. On three instances since this matter was filed, the Petitioner has stated she
will not come to South Carolina for the hearing on this matter. She also has not indicated that she will be represented by
counsel at a hearing in this matter. It does not seem prudent to schedule this case for hearing when Petitioner has said she
will not be present. Petitioner wishes to have her case heard in her absence with the Division considering the documents
she has submitted. However, this is deemed a failure to prosecute and the case cannot go forward in that manner.
THEREFORE, IT IS HEREBY ORDERED that pursuant to the South Carolina Rules of Procedure for the
Administrative Law Judge Division and the South Carolina Rules of Civil Procedure this case is DISMISSED WITH
PREJUDICE. See ALJD Rule 23 and SCRP Rule 41 (b). AND IT IS SO ORDERED.
