FINAL ORDER

This matter came before the Administrative Law Judge Division on January 28, 1999 for a contested case hearing. At the hearing, Respondent consented on the record, that for the violation of 27 S.C. Code Ann. Regulation 7-9(B) (Supp. 1997), committed on May 8, 1998, Respondent would surrender his beer and wine permit for a thirty day suspension and remit to the South Carolina Department of Revenue ("Department") a monetary penalty in the amount of $350.00 no later than ten days from the hearing. The Department agreed to accept the suspension and monetary fine for the violation.

I find this fair and equitable, approve such consent order and hereby order its adoption. As such, this matter is DISMISSED WITH PREJUDICE.

IT IS SO ORDERED.
