ORDER AND DECISION

This matter was before the Administrative Law Judge Division pursuant to administrative violation written against Respondent, Leonard Gregory, d/b/a Gregory's Superette located at 4 Maple Street, Charleston, South Carolina. After notice to the parties a hearing was scheduled for Monday, January 6, 1997 at the Administrative Law Judge Division. Prior to the hearing, the parties reached an agreement to resolve the matter. Mr. Gregory admitted the violation occurred. The admitted facts are as contained the Department's Final Determination letter as follows:

Mr. Gregory holds an off-premises beer and wine permit, BW#613918. On February 5, 1996, SLED agents observed employees of Burris Discount Party Shop load approximately twenty-four (24) cases of assorted types of beer in a white Ford van. The van was followed to Gregory's Superette at 4 Maple Street, Charleston, South Carolina, where the beer was unloaded and carried into Gregory's Superette. The beer was then placed into coolers located in the store for resale. The agent issued a citation for purchasing beer by a retailer from another retailer in violation of S.C. Code Ann. §61-9-170 (Supp. 1995).

The Department seeks a monetary penalty of $800 because this a second violation for the permittee. Mr. Gregory agrees to the payment of the fine, but request sixty (60) days in which to make the payment.

Having admitted the violation, IT IS HEREBY ORDERED, that the respondent, Leonard Gregory, pay a monetary penalty of $800 within sixty (60) days of the date of this Order. If the fine is not paid in full within the time specified, the off-premises beer and wine permit is ordered suspended for fifteen days. The license shall be surrendered to the Department in the manner provided by law. A copy of the Order shall be posted at the location during the period of suspension.
