ORDERS:
ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division ("Division")
on the application of Joseph L. Hicks, TMD Corp., d/b/a Hess Mart, located at 247 North Irby Street,
Florence, South Carolina for an off-premises beer & wine permit (AI-117967). This application was
protested by William P. Diggs, Pastor of Trinity Baptist Church, and Terry Alexander, of Florence
County Council. After notice to the parties a hearing was scheduled for July 23, 1998. The Notice
of Hearing was sent certified to both Protestants. William P. Diggs and Terry Alexander each
received notice on June 19, 1998. Neither Protestant appeared at the hearing and their protests are
deemed abandoned. No other protests were made to this application.
IT IS THEREFORE ORDERED that the above-referenced matter is forwarded to the
Department of Revenue to continue to process the application of Joseph L. Hicks.
IT IS FURTHERED ORDERED that this matter is DISMISSED.
AND IT IS SO ORDERED.
