ORDER OF DISMISSAL

This matter comes before me upon request for a Hearing by the Petitioner, who is seeking an off-premise beer and wine permit for Direct Discount Beverage, at 202 South Beltline Boulevard, Columbia, South Carolina. The South Carolina Department of Revenue (Department) made a Motion to be Excused, which was granted by my Order dated September 16, 1997.

A hearing was scheduled to be held on November 10, 1997, at the Administrative Law Judge Division, Columbia, South Carolina. Before the hearing began, the Protestant informed the Court that she had reached a settlement with the Petitioner and had decided to withdraw her protest. Finding good cause,

IT IS HEREBY ORDERED that the off-premise beer and wine permit application of Bharat K. Patel, Zambezi, Inc., d/b/a Direct Discount Beverage, at 202 South Beltline Boulevard, Columbia, South Carolina, be GRANTED once payment of the required fees and costs is made by the Petitioner to the Department.

AND IT IS SO ORDERED.
