ORDERS:
ORDER AND DECISION
This matter was pending before the Administrative Law Judge Division pursuant to S. C. Code
Ann. §§ 61-9-320 and 61-5-50 (Supp. 1995) for the issuance of an on-premises beer and wine permit and
sales and consumption (minibottle) license to the Petitioner, Robert A. Salvatierra, d/b/a Cozy Nook at
1030-B Redneck Road, Goose Creek, South Carolina. The issuances of these permits were protested by
the Pastor, Reverend Todd Brady, and members of Harbour Lake Baptist Church located at 111 Bayshore
Boulevard, Goose Creek, South Carolina on signed petitions.
Based upon further investigation and discussions between the parties, (Robert Salvatierra, Pastor
Brady and Lake Harbour Baptist Church Management Team), it appears that a settlement agreement has
been reached. The parties are in accord with the settlement agreement. By letter dated May 15, 1996,
(herein attached as Exhibit A), the Protestants have withdrawn their protest.
The Department has stated in its Motion to be Excused, that there is no controversy between the
applicant and the Department. The Department would have issued the permit but for the protest issue
concerning the suitability of the location. Since the protests have been withdrawn, no further action is
necessary in the above referenced case. It is therefore,
ORDERED, that the above referenced case is DISMISSED and returned to the Department for
further processing.
AND IT IS SO ORDERED.
