ORDERS:
ORDER OF DISMISSAL
The above matter was assigned to me on April 19, 1996. After that assignment, the
Petitioner's attorney, James H. Harrison, made a Motion that this case be dismissed because
the Protestant is a fictitious individual and that this protest was an apparent attempt to delay
the opening of the Petitioner's business. In a letter dated May 3, 1996, Arlene D. Hand,
attorney for the Respondent, informed me that the Department also believes that the Protestant
is a fictitious individual. The Department therefore joined in the Petitioner's request that this
case be dismissed. It is therefore,
ORDERED that this case be dismissed and that the Petitioner's application for a
business sale and consumption license and an on-premise beer and wine permit be granted upon
the payment of the required fee and cost by the Petitioner
AND IT IS SO ORDERED.
