CONSENT ORDER TO STRIKE FROM DOCKET

A motion of C.C. Harness, III, attorney for the Petitioners, by in with the consent of Mary D. Shahid, general counsel for the office of Ocean and Coastal Resource Management, and it appearing that the parties are in agreement for removal of this case from the docket pursuant to Rule 40-(j) of the SCRCP as made applicable by Rule 52 of the Administrative Law Judge Division,

IT IS ORDER that the above entitled action, including all claims there in asserted by all parties, be and is here by stricken from the docket with right to restore. All further agree that if the claim is restored upon motion made within one year of the date stricken, statute of limitation shall be tolled as to all consenting parties during the time the case is stricken, and any unexpired portion of the statute of limitations on the date the case was stricken shall remain and begin to run on the date the claim is restored.

It is Ordered, this 24th day of July, 2000.
