ORDER OF DISMISSAL

In this matter, Petitioner appealed permit # 97-1X-320-P, which the Department issued to Respondent Ronald E. Hoover. This permit authorizes Respondent to conduct various activities associated with management of a twelve acre tidal impoundment on and adjacent to Steamboat Creek in Charleston, South Carolina. Because Petitioner believed that the activities authorized by Respondent's permit would result in a trespass upon his property, he filed an appeal of the permit, and requested a contested case hearing before this Division. However, by letter dated May 15, 1998, Marvin I. Oberman, Attorney for Petitioner, advised this tribunal that the engineers/surveyors had just completed their boundary determinative work, and contrary to earlier reports, the permit would not result in a trespass upon Petitioner's property. Accordingly, Petitioner now moves this tribunal for a dismissal of this matter.

IT IS THEREFORE ORDERED that this matter is hereby dismissed.

AND IT IS SO ORDERED.
