ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Court pursuant to a Petition for Review by Mark Blatchford
("Petitioner") seeking review of an Enforcement Order issued by the South Carolina Department
of Health and Environmental Control, Bureau of Ocean and Coastal Resource Management,
("Respondent"). Prior to the date set for trial of the issues, the parties to the above-entitled action
have agreed to settle the matter.
This Consent Order has been provided to the Court by the parties and represents their
agreement that:
1. Petitioner agrees to remove a 10' x 16' section of the existing fixed pierhead as
shown in the attached drawing and letter dated April 4, 1997, from Deborah Blatchford and
incorporated herein as Attachment A, to the satisfaction of OCRM staff, except for pilings and
any beams or bracing necessary to construct a boat lift in this area. This work shall be
accomplished within sixty (60) days of execution of this order.
2. Petitioner agrees to submit a permit application requesting authorization for the
construction of a boat lift in the area where the fixed pierhead was removed and for after-the-fact
approval of all other variances from the original permit as noted in Enforcement Order 96C-001M. Such permit application will be submitted within thirty (30) days of execution of this
consent order.
3. Petitioner agrees to pay a civil penalty in the amount of two hundred and fifty
($250) dollars within thirty (30) days of execution of this consent order.
4. Respondent agrees to withdraw Enforcement Order 96C-001 M.
THEREFORE, with the consent of the parties, it is hereby ORDERED that Docket
Number 97-ALL-07-0054-CC is hereby dismissed with prejudice.
AND IT IS SO ORDERED.
