ORDER OF DISMISSAL

This matter comes before me pursuant to S.C. Code Ann. § 1-23-310 et seq. (Supp. 1994). Petitioner, Creek Watch Villas Owners' Association, contested the South Carolina Department of Health and Environmental Control's issuance of an amendment for realigning the boat ramp at the terminus of Captain Sam's Road, Seabrook Island, Charleston County, South Carolina. However, by petitioner's letter dated September 6, 1995, this tribunal has been advised that petitioner rescinded its letter of Notice of Intent to Appeal. Therefore, a hearing is no longer necessary.

IT IS THEREFORE ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
