ORDERS:
ORDER FOR CONSOLIDATION
This matter is currently pending before the South Carolina Law Judge Division, along with
case 03-ALJ-07-0301, F. Carlisle Smith v. South Carolina Department of Health and Environmental
Control and James Golden Poultry Farms. On August 19, 2003, the Respondent South Carolina
Department of Health and Environmental Control filed a Motion for Consolidation in the two cases.
The Petitioners did not respond to the Motion. It appearing that the facts, circumstances, and issues
are common to the cases, and that the two Petitioners are both neighboring landowners to the
proposed farm, it is hereby ORDERED that these matters are consolidated into one contested case.
IT IS FURTHER ORDERED that the caption in this matter will read “F. Carlisle Smith and
Robert T. Boland vs. South Carolina Department of Health and Environmental Control and James
Golden Poultry Farms,” and shall bear Docket No. 03-ALJ-07-0301-CC.
AND IT IS SO ORDERED.
