CONSENT ORDER

This matter is before me by consent of all parties for entry of a consent order. This contested case is an appeal taken by the Petitioner following OCRM's conditional issuance of permit no. OCRM-01-182-R. The Petitioner applied with the Department for a permit to construct a private dock on and adjacent to Horlbeck Creek at Lot 61, Parkers Landing Road, Rivertowne Country Club, Mount Pleasant, South Carolina. The application proposed a 4' x 613' walkway leading to a 15' x 16' covered fixed pierhead. Floodside, a 3' x 20' ramp will access a 10' x 20' floating dock. Ebbside, a 12' x 12' boatlift was proposed. The Department issued the permit but imposed several special conditions, including one that reduced the total combined square footage of the fixed pierhead and floating dock to 160 square feet.

After further review of the permit application, as well as the other structures on Horlbeck Creek in the vicinity, the Department has concluded that the size of the creek is sufficient to allow a total combined square footage of 310 square feet for the fixed pierhead and floating dock. All other permit conditions will remain the same. The parties agree that this agreement shall be binding on the Petitioner's heirs and assigns.









It is therefore, ORDERED that permit number OCRM-01-182-R is hereby amended to allow for a total combined square footage of 310 feet and this appeal is hereby dismissed with prejudice.

AND IT IS SO ORDERED.
