CONSENT ORDER

The above-entitled case is pending before the Administrative Law Judge Division. On July 5, 2000, the Court was notified by Respondent, William Culley, that he will not be constructing a private dock on a tributary of Brickyard Creek at Lot 4 Riverview Drive in the Pleasant Point Plantation on Lady's Island, Beaufort County, South Carolina, due to the fact that the dock would have a negative impact upon the view and natural beauty of the area. There being no further controversy in this matter, the remaining parties join in the Consent Order for dismissal of the case.



IT IS HEREBY ORDERED that this contested case hearing is dismissed without prejudice. IT IS FURTHER ORDERED that permit number OCRM-00-934 is withdrawn.



AND IT IS SO ORDERED.
