ORDERS:
CONSENT ORDER
This matter is before me by agreement of the parties for entry of a Consent Order. This is an appeal taken by the Petitioner following
OCRM's conditional issuance of a permit to construct a private dock at 391 Bull's Island Road in Awendaw, Charleston County,
South Carolina. The Petitioners applied to construct a 400' walkway with handrails, leading to an 18' x 18' fixed pierhead with a roof.
On the left side of the pierhead, the Petitioner proposed a four-pile 12' x 22' boatlift. The permit was issued, but was conditioned upon
shortening the length of the walkway by 66' (Special Condition Three), and removing the roof (Special Condition Two). The
Petitioners contest these two special conditions.
After a review of the project and further discussion, the parties agree that Special Condition Three will remain a condition of the
permit. The parties further agree that Special Condition Two shall be deleted, allowing the construction of a roof over the pierhead.
This agreement shall be binding on othe parties' heirs and assigns.
THEREFORE, it is ORDERED that this appeal is hereby dismissed with prejudice, and that permit number OCRM-00-245-J iss
issued, with Special Condition Two deleted.
AND IT IS SO ORDERED.
