ORDER AND DECISION
STATEMENT OF THE CASE
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310 et seq. (Supp. 1995)
for a hearing pursuant to the applications of Betty L. Caudill, d/b/a LakeVue Landing, Inc., d/b/a
Lake Vue Landing (applicant). The applicant seeks renewal of an on-premise beer and wine permit
(AI 102670) and renewal of a business sale and consumption license (AI 102671) for Route 4, Box
1144, Manning, Clarendon County, South Carolina.
Notice of the date, time, place and nature of the hearing was timely given to all parties and
to the sole protestant of record, Evelyn Banning Jones. On March 5, 1996, this Tribunal received
a letter from Ms. Jones advising that she would not be in attendance at the hearing due to work
commitments.
The hearing was held on March 27, 1996, at the Administrative Law Judge Division offices.
The sole protestant of record, Ms. Jones, did not appear at the hearing, thereby waiving any protest.
After reviewing the file, and the evidence contained therein with the applicant, I have determined that
all statutory provisions have been complied with for the renewal of the beer and wine permit and
renewal of the business sale and consumption license. Further, there being no opposition at the
hearing to Petitioner's renewal applications, it is hereby
ORDERED that this matter is dismissed, and
IT IS FURTHER ORDERED that the Department of Revenue and Taxation grant the renewal
applications of Betty L. Caudill, d/b/a LakeVue Landing, Inc., d/b/a Lake Vue Landing for an on-premise beer and wine permit and a business sale and consumption license for Route 4, Box 1144,
Manning, Clarendon County, South Carolina.
AND IT IS SO ORDERED.
