ORDER AMENDING DECISION

On March 15, 2002, Kenneth Allen, attorney for Petitioner, forwarded a letter to this tribunal from W. Dott Bellamy and Maxine Bellamy, owners and residents of the property adjoining the Petitioner's business. In that letter, the Bellamys state that they do not want a fence constructed between their property and the Petitioner's store, as stipulated to by the Petitioner at the hearing of this case and thereby imposed as a restriction upon Petitioner's off-premises beer and wine permit by this tribunal in its Final Order and Decision in this matter. Therefore, the Bellamys request that this tribunal amend its Final Order and Decision to remove this stipulated restriction.

IT IS THEREFORE ORDERED that page 3 of the Final Order and Decision issued by this tribunal on March 7, 2002 in this case is AMENDED to delete Stipulation #2 in its entirety.

AND IT IS SO ORDERED.
