ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Judge Division. This matter involves the denial of the Petitioner's request for an on-premises beer and wine permit by the Department of Revenue based on public protests as to suitability of the location by Mark S. Watford, Paul and Sheree Moore, and Alan and Melissa Champy. Based on the Agency Transmittal sent by the Department, but for the public protests, the permit would have been granted. By letter dated September 18, 2001, all of the aforementioned Protestants withdrew their protests. Because the Department would have granted the permit but for the protests, and the protests have all been withdrawn, it is hereby:

ORDERED that this matter is dismissed with prejudice; and

IT IS FURTHER ORDERED that the Department of Revenue issue an on-premises beer and wine permit to the Petitioner for the location at 15080 Dunbarton Boulevard, Barnwell, South Carolina.

AND IT IS SO ORDERED.
