ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the ALJ Division on petition by Jackson E. Greene, Jr. for review of
the Department’s action in issuing Administrative Order 02-38-SW for 10049 Old White Horse
Road (Site), Greenville County, South Carolina. The parties have resolved their differences.
Administrative Order 02-38-SW cites Mr. Greene for unlawfully disposing municipal solid
waste, construction and demolition debris, and tires at the Site. The contested Administrative
Order requires Mr. Greene to cease unpermitted disposal activities, clean up the Site, pay a civil
penalty of four thousand six hundred ($4,600.00) dollars, and obtain a permit prior to any further
disposal.
Mr. Greene has complied with the Administrative Order by cleaning the Site. The parties
have agreed to settle the penalty at two thousand three hundred ($2,300.00) dollars.
Based on the foregoing, Jackson E. Greene, Jr. agrees to withdraw his petition in the
pending case.
Accordingly, and with the consent of the parties, this case is dismissed.
AND IT IS SO ORDERED.
