ORDER OF DISMISSAL

This matter comes before this tribunal pursuant to S.C. Code Ann. § 61-2-260 (Supp. 2000), S.C. Code Ann. § 61-4-525 (Supp. 2000), and S.C. Code Ann. § 1-23-310, et seq. (Supp. 2000) for a contested case hearing. Petitioner applied for an on-premises beer and wine permit and a nonprofit private club minibottle license for an establishment located at 136 State Street, West Columbia, South Carolina. By letter dated February 23, 2001, Mr. Curtis Loftis informed this tribunal that all protestants of record wish to withdraw their protest of Petitioner's application. S.C. Code Ann. § 61-4-520 (Supp. 2000) establishes the criteria for the issuance of a beer and wine permit. S.C. Code Ann. § 61-6-1820 (Supp. 2000) establishes the criteria for the issuance of a nonprofit private club minibottle license. In its Agency Transmittal, the Department advised this tribunal that Petitioner appears to have met all statutory requirements, and but for the protests, the Department would have issued the permit.

IT IS THEREFORE ORDERED that the hearing scheduled for February 27, 2001, is canceled. IT IS FURTHER ORDERED that the Department of Revenue shall continue to process Petitioner's application for an on-premises beer and wine permit and a nonprofit private club minibottle license for 136 State Street, West Columbia, South Carolina.

AND IT IS SO ORDERED.
