ORDERS:

CONSENT ORDER

At the hearing on this matter held on May 5, 2003, before the Honorable Marvin F. Kittrell, Chief Administrative Law Judge, the parties agreed to the following terms, resolving the matter and incorporated into this Final Consent Order:

1.For the violation of S.C. Code Ann. Section 61-4-580(5) (Supp. 2002) on September 27, 2001, L& J Inc. of Myrtle Beach, d/b/a BT’s, agrees to surrender its sales and consumption license and beer and wine permit to the South Carolina Department of Revenue (Department) no later than 5:00 p.m. on May 30, 2003. Further, it agrees that it will not apply for any alcohol licenses (sales and consumption as well as beer and wine permit) in this State, either as a shareholder, entity or principal for a period of two years. This two year period begins May 30, 2002 and runs continuously for a period of two years from that date. Further, the current principals of L&J Inc. of South Carolina, John Kotsopoulos and Larry Wayne Jones, agree that they will not apply for any alcohol licenses, nor hold an interest in any entity who applies for or obtains a license for a two year period beginning May 30, 2003, and running continuously for a two year period beginning on that date.

2.The Department accepts the above referenced in satisfaction on L&J’s violation of Section 61-4-580(5) on September 27, 2001.

The parties freely and voluntarily entered into this agreement. Further the parties agree that this constitutes the full and final resolution of this matter.

It is therefore ORDERED that this matter is DISMISSED WITH PREJUDICE.

IT IS SO ORDERED.
