ORDERS:
CONSENT ORDER OF DISMISSAL
The parties hereby have come to the following agreement that
this matter is hereby dismissed with the consent of the parties with the
following stipulations:
1. Nothing in the Department’s decision of May 18, 2006, shall preclude Youwall, LLC. from filing an application for a Class II
Industrial Waste Landfill at the 140 Gill Street, Appleton Site at such a time
when future amendments to the Three Rivers Regional Solid Waste Management Plan
render this facility consistent with the Plan.
2. Nothing in the Department’s decision of May 18, 2006, shall preclude Youwall, LLC. from immediately re-filing its Demonstration-of-Need
for a Class II Industrial Waste Landfill at the 140 Gill Street, Appleton Site.
