ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division on Petitioner’s request for a
contested case hearing challenging Administrative Order No. 02-258-W issued by Respondent South
Carolina Department of Health and Environmental Control. Prior to the scheduled hearing date, the
parties agreed to settle the contested case as follows:
(1) No later than June 1, 2003, Petitioner shall complete the installation of pipe and inlet
boxes and the stabilization and grassing of the area in question as proposed in the engineering plans
by Jordan Jones & Goulding submitted to the Department; and
(2) Within 30 days of receipt of this signed Order, Petitioner will pay to the Department a
penalty in the amount of $20,500.00.
NOW, THEREFORE, upon the agreement of the parties, IT IS ORDERED that this matter
is hereby DISMISSED with prejudice.
AND IT IS SO ORDERED.
