ORDERS:
Final ORDER
COME NOW counsel for Petitioner South Carolina
Department of Health and Environmental Control (DHEC or Department) and
Respondent Win Joseph, LLC (Win Joseph) and announce to the Court that this
matter has been resolved to the satisfaction of the parties. In settling this
matter, the parties have agreed to the following:
1. Without any admission of the matters contained
in the Findings of Fact and Conclusions of Law set forth in Administrative
Order 05-126-W (Administrative Order) issued by DHEC, Win Joseph agrees to pay
to the Department a civil penalty in the amount of twelve thousand five hundred
dollars (12,500.00).
2. The payment of the civil penalty is a full and
final disposition of any and all requirements sought to be imposed upon Win
Joseph by the Administrative Order.
3. The civil penalty shall be due and payable
within thirty (30) days of entry of this Order.
4. Either party may move to enforce the terms of
this Order by seeking an order from the Administrative Law Court for contempt
of court, injunctive relief, and/or such other remedial writs or relief
provided by law.
IT IS HEREBY ORDERED.
