ORDERS:
CONSENT ORDER OF DISMISSAL
I am informed, as shown
by the signatures of the counsel to the parties in this action, that a
settlement has been reached in this litigation. More specifically, the parties
have agreed to the payment of the sum of $2,250,383 in settlement of all
issues. This amount is for tax years ended 12/31/1990 through 12/31/2001 and
includes corporate income tax and license fee of $926,063, interest and penalty
of $1,324,320. The parties have also agreed that as of 12/31/2001, the amount
of the taxpayer’s net operating loss carry-forward was $4,497,463.
Based upon the
representations of counsel that there are no matters in dispute between the
parties, I hereby order that this action is ended with prejudice and finality.
And it is so Ordered.
