ORDERS:
ORDER FOR CONSOLIDATION
This
matter is currently pending before the South Carolina Administrative Law Court,
along with case 05-ALJ-07-0477-CC, Tracey Walker and Randy Marvin v. South
Carolina Department of Health and Environmental Control and Mike Carroll. On
February 14, 2006, the Petitioners in both cases, Tracey Walker and Randy
Marvin, filed a Motion to Consolidate in the two cases. Both Respondents South
Carolina Department of Health and Environmental Control and Mike Carroll consented
to the Motion. It appears that the facts, circumstances, and issues are common
to the cases, that both cases involve the same questions of law and facts, and
that the same or substantially similar evidence will be relevant. Therefore,
in the interest of judicial economy and with the consent of the Parties, it is
hereby ORDERED that these matters are consolidated into one contested
case as provided in SC ALC Rule 19 (D).
IT
IS FURTHER ORDERED that the caption in this matter will read “Tracey Walker
and Randy Marvin, Petitioners v. South Carolina Department of Health and
Environmental Control and Mike Carroll, Respondents” and shall bear Docket No.
05-ALJ-07-0477-CC. The file for Tracey Walker v. South Carolina Department of
Health and Environmental Control, Docket 05-ALJ-07-0476-CC shall be closed and
merged into case 05-ALJ-07-0477-CC.

IT IS SO ORDERED.
