ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Court (“ALC” or “Court”) for a contested case hearing upon the request of Petitioner filed April 5, 2006.

A hearing on the merits was scheduled to begin on Thursday, June 22, 2006 at 10:00 a.m. at the Administrative Law Court. On June 19, 2006, James F. Julian, the sole protestant in this case, notified the Court of his desire to withdraw his protest in this matter.

IT IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED WITH PREJUDICE.

IT IS FURTHER ORDERED that the South Carolina Department of Revenue continue processing Petitioner’s application for an on-premises beer and wine permit for its location at 685 S.E. Main Street, Simpsonville, South Carolina.

AND IT IS SO ORDERED.
