ORDERS:
ORDER OF REMAND
(Proposed Regulation)
This matter comes before me pursuant to
South Carolina Department of Labor, Licensing and Regulation, Boiler Safety
Program regarding proposed regulations on Boiler Safety. By Order dated January
3, 2006, this court granted a request for a continuance of the hearing on the
proposed regulation with the indication that if SC LLR determined that a new
notice and comment period was needed, that this case would be remanded. By
letter dated January 24, 2006, Susan Duncan, Legislative Coordinator for SC LLR
requested that remand so that a new proposal could be submitted.
IT IS THEREFORE ORDERED that this case is REMANDED to LLR for a
new notice and comment period as required. Since SC LLR will submit the new
proposal as a new regulatory file, SC ALC case number 05-ALJ-11-0432-RH is
closed.
AND IT IS SO ORDERED.
