ORDER OF DISMISSAL
THIS MATTER COMES before me at the request of the Petitioner, Reynolds Fence &
Guardrail, Inc., which moves for a voluntary dismissal of the above-captioned contested case. By letter dated October 10, 2005, the Court was notified that the Petitioner wished to withdraw its request for a contested case hearing. Based on good cause shown,
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, this action, including all claims herein asserted by all parties, is hereby dismissed, with each party to bear its own attorneys’ fees and costs.
AND IT IS SO ORDERED.
