ORDERS:

ORDER

The South Carolina Department of Revenue (hereinafter “the Department”) initiated this matter by issuing a Final Determination that Alshamlah Fathi d/b/a Knight Supermarket at 77 Hanover Street, Charleston, South Carolina had violated South Carolina Code Ann. 61-4-580(3) on February 4, 2005 by permitting “games of chance” on its licensed premises. Prior to a hearing on this matter, the Department agreed to dismiss this case with prejudice and agreed that this matter will not constitute a violation against Fathi’s permit. The parties agree that they freely and voluntarily entered into this agreement and that said Order constitutes a full and final resolution of this matter.

I find the above to be fair and equitable, approve the dismissal of this matter and retain continuing jurisdiction to enforce this Order. I also order this matter dismissed with prejudice.

AND IT IS SO ORDERED.
