ORDER OF DISMISSAL
This matter is before the Administrative Law Court (Court) pursuant to a request for a contested case hearing filed by The Pantry, Inc., d/b/a Pantry 908 on May 5, 2005. By letter dated August 17, 2005, counsel for The Pantry notified the Court that it wished to withdraw its request for a contested case hearing. Therefore,
IT IS HEREBY ORDERED that this matter is dismissed with prejudice.
AND IT IS SO ORDERED.
