ORDER OF DISMISSAL

On August 22, 2005, counsel for Petitioner Ape Hangers, Inc., provided this Court with a copy of a letter submitted by the Chesterfield County Sheriff’s Office to the South Carolina Department of Revenue. In the letter, the Sheriff’s Office, the sole protestant of record in this matter, indicated that it was withdrawing its protest against Petitioner’s requested permit and license. Therefore, as the sole protestant in this matter has withdrawn its protest of Petitioner’s permit and license application,

IT IS HEREBY ORDERED that the above-captioned case is DISMISSED.

IT IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina Department of Revenue shall CONTINUE TO PROCESS Petitioner’s application for an on-premises beer and wine permit and non-profit private club minibottle license for the premises located at 2348 Highway 601 North in Pageland, South Carolina.

AND IT IS SO ORDERED.
