ORDERS:
ORDER OF DISMISSAL FOR DEFAULT
An Order and Notice of Hearing was issued in this matter on May 24, 2005, informing the parties that a hearing was scheduled for Tuesday, July 12, 2005, at 9:30 a.m. at the Laurens County Courthouse, Courtroom L-9, Judicial Square, 100 Hillcrest Square, Laurens, South Carolina.
Petitioner failed to comply with the May 24, 2005 Order since he failed to appear on July 12, 2005, to prosecute the case here in dispute. Due to Petitioner’s failure to adhere to an interlocutory order, and failure to appear at the hearing, the Administrative Law Judge may dismiss such a case in a manner that upholds the position of the complying party. ALC Rule 23.
Therefore, since the South Carolina Department of Health and Environmental Control appeared at the hearing prepared to litigate the contested case and since Petitioner failed to appear, IT IS ORDERED that Gerald T. Ledbetter’s applications 2004110011 and 2004110012 for septic tank permits are denied.
AND IT IS SO ORDERED.
