ORDERS:

CONSENT ORDER OF DISMISSAL

Background:

 

This is direct appeal (de novo) from a final determination of the Director of the S.C. Retirement System denying the Petitioner’s request to purchase additional credible time. The time in question is time (approximately two (2) years) during which the Petitioner worked as an attorney for a legal aid unit (Palmetto Legal Services (PLS)). The Parties have submitted Statement of The Case and have proffered various items of evidence. A hearing is set for the morning of June 22, 2005.

 

 

Agreement:

 

Prior to the call of the case, the Parties announced that an Agreement had been reached between them. The Agreement is as follows:

 

1.                    That, in the event that any local legal services grantees in South Carolina are allowed to participate in the South Carolina Retirement System, the Petitioner shall be able to purchase his time employed at PLS as though he would have if his application, which is the subject of this case, had been approved;

 

2.                    That, the matter will be dismissed without prejudice.

 

 

I have reviewed the documents submitted by the Parties in this matter, including the request for appeal, and the other submissions. I find that the Agreement set forth above is reasonable and equitable and should be ratified and included in this, the Administrative Law Court’s Order in the matter.

 

 

IT IS SO ORDERED, AND THIS MATTER IS HEREBY DISMISSED.
