ORDER OF DISMISSAL

THIS MATTER COMES before me at the request of the Petitioner, B. Christina Filyaw

which, with the agreement of the Respondent, South Carolina Department of Health and Environment Control (“DHEC”), requests a voluntary dismissal of the above-captioned contested case. By letter dated June 2, 2005 this court was notified that the parties had settled this matter, and that the Petitioner’s septic tank permits had been issued. Based on good cause shown,

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, with the acquiescence of all parties hereto, this action, including all claims herein asserted by all parties, is hereby dismissed, with each party to bear its own attorneys’ fees and costs.

 

AND IT IS SO ORDERED.
