A hearing on the above proposed regulation was set for Wednesday, April 20, 2005, at
10:00 a.m. ALC Rule 45 requires the agency to provide a statement, at least ten (10) days before
the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp.2004) on the basis that a request for a hearing was made by twenty-five (25)
persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. The Court was advised by letter dated April 4, 2005, from Rachel Erwin,
Assistant General Counsel for the South Carolina Department of Public Safety, that the
Department did not receive any requests for a hearing on the proposed regulation in the above
matter, and that the hearing will not be necessary.
IT IS THEREFORE ORDERED that the above-captioned case bearing Docket
Number 05-ALJ-11-0049-RH is hereby dismissed.
AND IT IS SO ORDERED.
