A hearing on the above-captioned matter was scheduled to begin at 9:00 a.m. on Tuesday, May 12, 2009. ALC Rule 45 requires the agency to provide a statement, at least ten days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (2005) on the basis that a request for a hearing was made by twenty-five persons, a governmental subdivision or agency, or an association having not less than twenty-five members. By letter dated May 8, 2009, the South Carolina Department of Insurance advised the court that it did not receive any such requests for a hearing on the regulation in the above-captioned matter and that a hearing will not be necessary. Therefore, it is
ORDERED that the hearing scheduled for May 12, 2009, is canceled. It is further
ORDERED that this matter is DISMISSED.
