ORDERS:
ORDER OF DISMISSAL
This matter comes
before the Administrative Law Court (ALC or Court) upon the request for a
contested case hearing pursuant to S.C. Code Ann. § 1-23-310 (Supp. 2007). The
case was scheduled to be heard on November 18 and 19, 2008. On October 23,
2008, Petitioner filed a consent motion requesting that this case be continued
in light of settlement negotiations. The parties were given sixty (60) days in
which to notify the Court as to whether a settlement had been reached. As of
the date of this Order, the Court has not received a Settlement Agreement from
the parties or a request for the case to be re-scheduled for a hearing. Therefore,
IT IS HEREBY ORDERED that this case is DISMISSED without prejudice.
IT IS FURTHER ORDERED that the parties shall be able to re-file this case without having to pay a
filing fee for a period of one (1) year from the date of this Order.
