ORDERS:
ORDER OF DISMISSAL
This
matter is before the undersigned pursuant to The Pantry, Inc., d/b/a Kangaroo
Express 791’s Request for a Contested Case Hearing filed with the Administrative Law Court on January 18, 2008. On January 6, 2009, the Respondent, through
its counsel of record, indicated that it wished to settle the matter fully and
agreed to the fine sought by the Department.
Based
on the representations of counsel for the parties, the Respondent has tendered
payment of the fine sought, and the Petitioner has accepted the same.
THEREFORE,
the issues being resolved by settlement, IT IS HEREBY ORDERED that the
above-captioned matter is hereby DISMISSED, WITH PREJUDICE.
AND
IT IS SO ORDERED.
