ORDERS:
ORDER GRANTING STAY
This matter comes
before the Administrative Law Court (ALC or Court) upon the request for a
contested case hearing pursuant to S.C. Code Ann. § 12-60-30 (Supp. 2006).
After the case was filed, Respondents made a Motion for Summary Judgment. On
February 9, 2007, James E. Smith made a Motion that this case again be stayed
pursuant to S.C. Code Ann. § 25-1-2260 (1989) due to his active military service
in the South Carolina National Guard. The Department of Revenue consented to
that Motion. Therefore,
IT IS HEREBY ORDERED that this case is continued and removed from the docket of the ALC.
IT IS FURTHER ORDERED that Mr. Smith shall notify the ALC with 15 days of his return. Upon that
notification the case shall be restored to the docket and set for a hearing.
AND IT IS SO
